Quick answer

Under the 70-hour/8-day rule you can't drive after 70 hours on duty in the last 8 days (60/7 if your carrier doesn't operate every day). Hours available = 70 − on-duty hours in the last 8 days; at midnight the oldest day drops off and its hours come back. A 34-hour restart resets the count (395.3(b)–(c)).

Worked example

9, 10, 8, 11, 9, 10, 10 and 0 hours (today) = 67 hours → 3:00 available now; at midnight the 9 hours from 8 days ago drop off → 12:00 available tomorrow.

How it's calculated

• On-duty total: Sum of all on-duty (driving + on-duty not driving) hours in the last 8 consecutive days (or 7 days under the 60/7 rule).

• Available now: Limit (70 or 60 hours) minus total on-duty hours used.

• Regained at midnight: The on-duty hours from the oldest day in the period drop off at 00:00 midnight.

• Available tomorrow: Calculated as Limit − (Hours used − Hours dropped), assuming no further on-duty time is logged today.

• 34-Hour restart: If a qualifying 34-hour off-duty restart ended on a specific day, hours prior to that restart are cleared from the calculation.
